Anti-terror bill gets final Senate nod; 2 senators vote against measure

Voting 19-2, senators approved Senate Bill 1083 or the Anti-Terrorism Act of 2020 seeking to amend the Human Security Act of 2007.

Under the measure, there are provisions introduced on penalizing those who will propose, incite, conspire, participate in the planning, training, preparation, and facilitation of a terrorist act; as well as those who will provide material support to terrorists, and recruit members in a terrorist organization.

The bill also seeks the establishment of Philippine jurisdiction over Filipino nationals who may join and fight with terrorist organizations outside the Philippines and ensure that foreign terrorists do not use the country as a transit point and as a safe haven to plan and train new recruits for terrorist attacks in other countries.

Republic Act No. 11479, or the Anti-Terrorism Act of 2020, repeals the Human Security Act of 2007, giving more surveillance powers to government forces. Among its contentious features is a provision allowing suspected terrorists to be arrested without warrant and detained without charges for up to 24 days.

Critics said the hotly-contested measure relaxes safeguards on human rights and is open to abuse, but lawmakers who authored and sponsored the bill said it is at par with the laws of other countries and will not be used against law-abiding citizens.

Duterte signed the Anti-Terrorism Act of 2020 (Republic Act 11479) on Friday despite objections from various groups, including the United Nations human rights body and the Bangsamoro Transition Authority.

Opponents of the new law may turn to the Supreme Court to invalidate the legislation on constitutional grounds.

MANILA – Saying "terrorism looms large", President Rodrigo Duterte on Wednesday defended the Anti-Terrorism Act of 2020 (Republic Act No. 11479) before the United Nations General Assembly, describing it as a “legal framework” to help curb terrorism in the country.

The Philippines continues to experience terrorism, the most recent was the two successive bomb explosions in Jolo, Sulu in August that killed several soldiers and civilians and injured 40 others.

Aside from the Marawi siege in 2017, other terrorist attacks include the Jolo Cathedral attack in 2019, and the Davao City night market bombing in September 2016, among others.

Duterte said the anti-terrorism law, which he signed in July this year, adheres to UN resolutions related to fighting terrorism.

Duterte’s top military and security officials cited the continuing threat of terrorist groups in the country, such as the Abu Sayyaf, as the main reason for the need for the law.

However, local and international human rights advocates, lawyer groups, and even some lawmakers opposed the law which they said might be abused by law enforcers.

Several petitions have been filed before the Supreme Court to challenge the constitutionality of the law.
